Terms of use

These are the terms for using Finished, the book tracking app. Please read them. They are short on purpose.

Who this agreement is with

This agreement is between you and get wobbled ltd, a company registered in the United Kingdom (company number 11737525), whose registered address is The Cow Shed, Off Packwood Lane, Lapworth, West Midlands, England, B94 6AU. In these terms, "we", "us" and "our" mean get wobbled ltd. "The app" means Finished, on any device you install it on.

By using the app you accept these terms. If you do not accept them, please do not use the app.

Apple is not part of this agreement. See the section on Apple below.

You must be 13 or older

You need to be at least 13 to use Finished. If you are under 18, please make sure a parent or guardian is happy for you to use it before you sign in and start posting.

We have set the App Store age rating to 13+, because the app carries writing by other people. If Apple's rating for the app is ever higher than 13, the higher age applies and takes precedence over this section.

What the app does

Finished lets you photograph a book cover to log it, keep a shelf, rate and review what you read, make cards to share, follow other readers, and see what they are reading.

The free half stays free. Logging books by camera or screenshot, your shelf, star ratings, written reviews, the standard Finished and Started cards, following people and looking at profiles are free and unlimited. We will not put any of those behind a payment later. Cover reading is never metered or capped.

The paid half is the AI finder, the deeper statistics and the premium card designs. See Subscription below.

We may add, change or remove features. If we remove something you paid for, see Subscription.

Your account

You do not need an account to use most of the app. Signing in is by Sign in with Apple only. There is no password.

• Keep your Apple Account secure. Anyone who can use it can use your Finished account.
• One person, one account. Do not impersonate somebody else, and do not pick a handle designed to look like somebody else.
• You are responsible for what is posted from your account.
• We can change a handle that impersonates a person or an organisation, or that is offensive.

Subscription

The paid half of Finished costs £29.99 a year or £4.99 a month, with a seven day free trial. Prices are in pounds sterling and include VAT where it applies. Prices shown in the App Store in your own country are the ones that will be charged.

How it is billed. The subscription is sold and billed by Apple, through your Apple Account, using In-App Purchase. We never see your card details.

The free trial. Seven days, and nothing is charged during it. If you cancel before the trial ends, you pay nothing. If you do not cancel, the trial rolls straight into a paid subscription and the first payment is taken then. If you have already had a trial, you may not be offered another.

It renews automatically. The subscription renews at the end of every period and your Apple Account is charged again, unless you cancel it at least 24 hours before the current period ends. It keeps renewing until you cancel.

How to cancel. Cancel in your Apple Account settings, on your device or in the App Store. Go to Settings, tap your name, then Subscriptions. You cannot cancel through us, and deleting the app does not cancel a subscription. If you cancel, the paid features stay open until the end of the period you have already paid for.

Refunds are Apple's. All purchases go through Apple, so all refunds are handled by Apple under Apple's terms, not by us. Ask Apple at reportaproblem.apple.com. We cannot give you a refund for an App Store purchase even if we would like to. This does not affect your legal rights as a consumer.

Price changes. If we change the price, Apple will tell you and ask you to agree before charging you more. If you do not agree, the subscription stops at the end of the current period.

Club and partner codes. A code from a book club or a launch partner records where you came from, and puts a badge on your profile. It does not change what you pay or what you get, unless the offer says otherwise in as many words.

Apple

These points are required by Apple and are part of this agreement.

• This agreement is between you and us only. Apple is not a party to it.
• Apple has no obligation to provide any maintenance or support for the app. Support requests go to us, at hello@thefinishedapp.com.
• We, not Apple, are responsible for the app and its content.
• If the app fails to conform to any warranty that cannot be disclaimed, you can tell Apple and Apple will refund the purchase price of the app, if any. Apple has no other warranty obligation at all, and anything else is our responsibility.
• We, not Apple, are responsible for dealing with any claim that the app or your use of it breaks a law, fails to meet a legal requirement, or infringes somebody's intellectual property, to the extent required by law.
• You confirm you are not in a country subject to a United States embargo or listed as a prohibited or restricted party, and that you will not use the app in a way any applicable export law forbids.
• Apple and Apple's subsidiaries are third party beneficiaries of these terms and may enforce them against you.
• Your use of the app must also follow Apple's own terms, including the App Store Terms of Service.

Using the app properly

Finished is for readers. Do not use it to:

• post anything unlawful, abusive, hateful, threatening or harassing, or anything that targets a person or a group because of who they are
• post sexual content, or anything involving children that would be inappropriate
• impersonate anybody, or pretend to be connected to a company or club you are not
• post spam, advertising, affiliate links or repeated promotion of anything
• scrape the app, hammer our servers, or use bots, scripts or automated tools against them
• try to get round the daily limits, the paywall, or the permissions the database enforces
• try to break into other people's accounts or into our systems
• post anybody's private information, yours or somebody else's

Spoilers. Please mark them or keep them out. A review that spoils a book is not against the law, but it can be reported and we may remove it.

Comments, reviews and moderation

Comments and reviews are moderated, and we can remove them.

• The app checks a comment before it is posted and refuses ones containing blocked words. The same check runs again on our server.
• Anybody can report a profile, a review or a comment. We read reports and act on them.
• We can remove any comment or review, hide it, or suspend or delete an account, if we think it breaks these terms. We will use judgement, and we will be quicker about abuse aimed at a person than about anything else.
• You can delete your own comments. You can also delete a comment somebody has left on your own post.
• You can block anybody. Blocking hides both of you from each other across the app.

We do not promise to read everything, or to catch everything. The filter and the reporting system are a first line, not a guarantee.

What you write stays yours

You own what you write. Your reviews, your comments, your bio and your profile name remain yours. We do not claim ownership of any of it.

To be able to show it, we need your permission. So by posting in Finished while signed in, you give us a worldwide, non-exclusive, royalty free licence to store, copy, display and distribute what you post, for the purpose of running and promoting Finished. That licence lasts as long as your content is in the app, and ends when you delete it, apart from copies in ordinary backups which are cleared in the normal course of things, and copies other people have already saved or screenshotted, which we cannot reach.

You confirm that what you post is yours to post, and does not infringe anybody else's rights.

If you send us an idea or a suggestion, we may use it without owing you anything. Please do not send us anything you want to keep to yourself.

Cards you make are yours to post anywhere you like, including Instagram and TikTok. Nothing in these terms restricts that.

What we own

The app itself, its name, its design, its code and its artwork belong to us or to the people we licensed them from. You get a personal, non-transferable licence to use the app on devices you own or control, in the ordinary way, for as long as you follow these terms. You may not copy it, sell it, rent it, reverse engineer it, or build a competing service out of it.

Book information and covers come from other people

Book titles, authors, page counts, ISBNs and cover images come from third-party catalogues, currently Open Library (run by the Internet Archive) and Apple's iTunes Search API.

• We do not own that information, and we do not guarantee it. Page counts, dates and even authors can be wrong or missing.
• Cover images are the copyright of the publishers and artists who made them. They are shown to help you identify a book.
• If a book's details are wrong you can correct them on your own shelf by hand.

If you own the rights in a cover or a description and want it taken down, write to hello@thefinishedapp.com and tell us what it is and where you saw it.

The AI finder

The finder uses an AI model to suggest books from what you ask for. It is a suggestion engine and it is sometimes wrong. It can name a book that does not exist, or put the wrong author on a real one. Check anything before you buy it.

The finder needs an account and a subscription, and is limited to twenty searches a day per person. That limit is there to stop automated abuse, and we can change it.

Availability

We would like the app to work all the time and it will not. We do not promise it will be available without interruption, that it will be free of faults, or that it will work on every device or with every version of iOS.

We may suspend the service to fix or improve it. If we ever shut Finished down, we will give you reasonable notice and a way to export your shelf.

Your shelf lives on your phone. Export it from Settings if it matters to you, and keep your device backed up. We are not your backup.

Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited under UK law. Your statutory rights as a consumer, including under the Consumer Rights Act 2015, are not affected by anything here.

Beyond that:

• We provide the app as it is. We are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data that we could not reasonably have foreseen.
• We are not responsible for what other users post, or for anything you do because of it.
• We are not responsible for third-party services the app touches: Apple, Open Library, Instagram, TikTok, or an AI provider. Their terms are between you and them.
• Where we are liable, our total liability to you is limited to the greater of the amount you have paid us in the twelve months before the claim, or £100.

If you are using the app for business rather than as a consumer, the paragraph above applies in full, and we exclude all warranties that the law allows us to exclude.

Ending it

You can leave whenever you like.

• Delete your account in Settings inside the app. Your profile, your public shelf, your posts, your comments, your likes and your follows are deleted with it. This cannot be undone.
• Deleting your account does not cancel a subscription. Cancel that in your Apple Account.
• Delete the app to remove the shelf from your phone, or use "Delete everything" in Settings first if you want it gone before the app is.

We can end it too. We can suspend or close your account if you break these terms, if you are abusive to other people, or if we have to for legal reasons. Where it is reasonable to do so we will tell you why and give you a chance to put it right. If we close your account for a serious breach you are not entitled to a refund, and Apple's refund policy still applies to anything you paid Apple.

Changes to these terms

We may change these terms, for example when the app changes or the law does. When we do we will update the date at the top and put the current version at thefinishedapp.com.

If a change matters, we will tell you in the app before it takes effect. Carrying on using the app after that means you accept the new terms. If you do not accept them, stop using the app and delete your account.

Odds and ends

• If a court decides part of these terms cannot be enforced, the rest still stands.
• If we do not enforce something straight away, we have not given up the right to enforce it later.
• These terms are the whole agreement between us about the app.
• You may not transfer your rights under these terms to anybody else. We may transfer ours, for example if the company is sold, as long as your rights are not reduced.

Law and courts

These terms and any dispute about them are governed by the law of England and Wales.

If you are a consumer, you can bring a claim in the courts of England and Wales, or in the courts of the part of the United Kingdom where you live. If you live in Scotland or Northern Ireland, the law of that country may apply instead where consumer law says so. If you are not a consumer, the courts of England and Wales have exclusive jurisdiction.

Nothing here takes away your rights under the consumer law of the country you live in.

Assumptions to check

• Age. These terms say 13 or older, and assume the App Store age rating is set to 13+. That is the right rating for an app carrying other people's writing, and 13 is also the age at which UK law lets somebody agree to an online service on their own. If the rating is set to 16+ or 18+ in App Store Connect, change the age in these terms to match.
• Governing law. Written as England and Wales, which is right for a company registered at Companies House in Cardiff. If get wobbled ltd is registered in Scotland, change it to Scotland.
